Dominic J. Cicero, D.M.D., who formerly practiced in Phillipsburg, New Jersey has permanently surrendered his New Jersey dental license The action resulted from a complaint by Claudia Megaro, who sought root canal treatment for a single tooth but was advised to have all of her amalgams fillings removed and replaced. She was also advised to have two other root canal treatments, one in a tooth that was giving her no trouble. During the next two years, she saw the Cicero regularly for various procedures but developed persistent, severe pain. In 2004, she filed a lawsuit charging that Cicero had failed to refer her for appropriate medical care for what ultimately turned out to be a severe infection (osteomyelitis) of her jaw bone. After the suit was filed, she discovered that the filling material Cicero used for her root canal treatments was RC-2W, a problematic paste used by practitioners of the Sargenti technique. Megaro also complained to the New Jersey Board of Dentistry, which concluded that his treatment of her constituted "gross and repeated acts of negligence." The lawsuit was settled in 2008 with payment of an undisclosed amount. In 2010, Cicero and the board entered into a consent order (shown below) under which he agreed to a license surrender (deemed a revocation) and payment of $670.50 for costs of the Board's investigation.

Administrative Action

CONSENT ORDER

The New Jersey State Board of Dentistry ("Board") received information alleging that Dominic J. Cicero, D.M.D. ("respondent"), had failed to treat patient C.M. within the standard of care in this State. Specifically, it has been alleged that respondent extracted tooth #3 and, when the patient complained of continuing pain, he performed an incision and drainage with deep curettage. He then placed Iodoform gauze and medicaments in the site and covered with an acrylic appliance. He repeated this process four times five days apart. When the treatment did not induce healing, respondent drilled into the aveolar bone to generate a vascular response. The patient ultimately developed an osteomyelitis resulting from the drilling into the aveolar bone.

On February 16, 2005, respondent appeared with counsel, Joseph Manning, Esq., at an investigative inquiry into the matter held by the Board. A civil suit between the patient and Dr. Cicero was settled. Having reviewed the entire record, including the testimony of  respondent at the investigative inquiry, the patient record, and materials forwarded to the Board by Dr. Cicero following his appearance, the Board finds that respondent's treatment of C.M. constituted gross and repeated acts of negligence. These facts establish basis for disciplinary action pursuant to N.J.S.A. 45: 1-21 (c) and (d). It appearing that respondent desires to resolve this matter without recourse to formal proceedings and for good cause shown:

IT IS ON THIS 21st  DAY OF December, 2010,

HEREBY ORDERED AND AGREED THAT:

1. Respondent's license to practice dentistry shall be and hereby is surrendered to be deemed a revocation effective immediately. Respondent agrees that he will not seek to be licensed again in this State. Respondent shall comply with the attached directives regarding suspended or revoked licensees.

2. Respondent is assessed the costs of the investigation to the State in this matter in the amount of $670.50. Payment for the costs shall be submitted by certified check or money order made payable to the State of New Jersey and submitted to the Board no later than thirty (30) days from the entry of this Consent Order. Payment shall be sent to Jonathan Eisenmenger, Executive Director, P.O. Box 45005, 124 Halsey Street, Newark, New Jersey 07101.
