License Revocation of Diane Meyer, D.D.S.

In 2013, the Illinois Department of Financial and Professional Regulation (IDFPR) revoked the dental and controlled substance licenses of Diane Meyer, D.D.S. The action was based on a complaint that alleged that she had acted improperly in connection with her treatment of three patients. The complaint charged that she:

When Meyer did not respond to invitations to attend a hearing, the IDFPR ordered the revocation and fine. However, she did not stop practicing. In January 2012, she restructured her practice as a "private membership association" in which patients sign a contract to indicate willingness to be treated without the usual protection by state government and the courts. She now practices under the name Holistic Dentistry Illinois where she offers a wide range of dubious practices. FINDINGS OF FACT, CONCLUSIONS OF LAW
AND RECOMMENDATION TO THE DIRECTOR

Now comes the Board of Dentistry of the Department of Financial and Professional Regulation of the State of Illinois and, after reviewing the record in this matter, a majority of its members hereby makes the following Findings of Fact, Conclusions of Law and Recommendation to the Director:

FINDINGS OF FACT

1. THAT Diane Meyer, Respondent, is now a duly licensed dentist in the State of Illinois, having been issued a Certificate of Registration, License No. 019022931, and a Controlled Substance License, No. 319011875, by the Department of Financial and Professional Regulation of the State of Illinois, Division of Professional Regulation (the "Department"). Respondent's said licenses are in non-renewed status.

2. THAT the Department filed a Complaint against the Respondent and sent notice of said Complaint to the Respondent by certified and regular mail on August 12, 2012 to Respondent's last known address in accordance with the Department's records.

3. Said Complaint alleged that Respondent abandoned patient H.S., charged patient H.S. for a Professional hospital visit that she did not make, willfully filed false records to document this activity, and refused to produce documents for patient H.S. requested by the Department for its investigation. She also was found to have abandoned patient P.P., refused to produce documents for patient P.P. requested by the Department for its investigation, charged patient P. P. for services not rendered, aided and abetted her son to engage in the unlicensed practice of dentistry, and displayed professional incompetence. She also used patient testimonials in her advertising, made statements to patient M.B. to influence, persuade, or induce dental patronage, and claimed to be able to provide alternative medicine and treatment in her advertisement.

4. THAT Respondent failed to appear either in person or  through counsel for a preliminary hearing on September 17, 2012 or for a status hearing on November 5, 2012.

5. THAT on September 17, 2012, the Administrative Law Judge ordered that Respondent file an Appearance and Answer to the Department's Complaint on or before October 22, 2012 or be subject to an order of default.

6. THAT date has now passed and no Answer or Appearance  has been filed by or on behalf of the Respondent.

7. THAT on November 5, 2012, the Administrative Law Judge  transferred this matter to the Board of Dentistry for its deliberations based on the pleadings.

8. THAT the allegations set forth in the above described  complaint are true and correct.

CONCLUSIONS OF LAW

1. THAT the Board of Dentistry of the Department of  Professional Regulation of the State of Illinois has jurisdiction over the subject matter and the parties in this case.

2. THAT the above Findings of Fact constitute sufficient grounds for discipline pursuant to 225 ILCS 25/23.6, 225 ILCS 25/23.7, 225 ILCS 25/23.9, 225 ILCS 25/23.11, 225 ILCS 25/23.17, 225 ILCS 25/23.29.

RECOMMENDATION

The Board of Dentistry of .the Department of Financial and Professional Regulation of the State of Illinois, after making the above Findings of Fact and Conclusions of Law, recommends to Jay Stewart, the Director of the Department of Financial and Professional Regulation, Division of Professional Regulation, that the Certificate of Registration as a Dentist, License No. 019022931, and Controlled Substance License, No. 319011875, of Diane Meyer be Revoked, and shall be fined $10,000 (ten thousand dollars) .

ORDER

THIS MATTER HAVING COME BEFORE ME on the Findings of Fact, Conclusions of Law and Recommendation to the Director issued by the Illinois Board of Dentistry of the Department of Financial and Professional Regulation of the State of Illinois; the Department having complied with all proper notice requirements; and Respondent having failed to file a Motion for Rehearing;

NOW, THEREFORE, I, JAY STEWART, THE DIRECTOR OF THE DIVISION OF PROFESSIONAL REGULATION of the DEPARTMENT OF FINANCIAL AND PROFESSIONAL REGULATION of the State of Illinois, hereby adopt the Findings of Fact and Conclusions of Law of the Board of Dentistry.

FURTHERMORE, I, JAY STEWART, THE DIRECTOR OF THE DIVISION OF PROFESSIONAL REGULATION of the DEPARTMENT OF FINANCIAL AND PROFESSIONAL REGULATION of the State of Illinois, hereby adopt the Recommendation of the Board of.

IT IS THEREFORE ORDERD THAT:

  1. Respondent's Certificate of Registration, License No. 19.022931, shall be and is REVOKED.
  2. Respondent's Certificate of Registration, License No. 319.011875, shall be REVOKED.
  3. Respondent is fined Ten Thousand Dollars ($10,000.00). Said fines payments shall be forwarded to: Illinois Department of Financial and Professional Regulation, SSe-Accounts Receivable Section - Fines, P.O. Box 7086, Springfield, IL 62791
  4. Respondent shall immediately surrender all Certificates of Registration and other indicia of licensure to the Department and upon Respondent's failure to do so, the Department shall seize same.
