Bryan Jepson, M.D., practices at the Thoughtful House Center for Children in Austin, Texas, which offers many unsubstantiated treatments for autism. In 2005, as noted below, the Texas Medical Board ordered him to pay a $1,000 administrative penalty. The Board's order, which stated that its action was "nondisciplinary, indicates that while Jepsen was applying for his Texas license, information on the Thoughtful House Web site suggested that he was already licensed.

AGREED NONDISCIPLINARY LICENSURE ORDER

On December 9, 2005, came on to be heard before the Texas Medical Board (the "Board"), duly in session, the matter of the application for a texas medical license by Bryan Layne Jepson, M.D. ("Applicant”).

On December 8, 2005, Applicant appeared in person, with counsel, Sam Stone, before the Licensure Committee of the Board. The Committee, after hearing from Applicant and after considering Applicant’s application, recommended that Applicant be granted a Texas medical license under certain terms, as set forth below, subject to the consideration and approval of the Board.

Based on the recommendation of the Committee, and with the consent of Applicant, the Board makes the following findings of fact and conclusions of law and enters this Agreed Order.

FINDINGS OF FACT

The Board finds that:

1. Applicant filed a written application for Texas medical license with the Board on May 19, 2005.

2. Applicant is 38 years of age.

3. Applicant is also licensed to practice in Michigan, Alaska, Colorado, Utah, and Montana.

4. Applicant's specialty is general practice. Applicant is board certified by the American Board of Emergency Medicine.

5. Applicant is a 1995 graduate of The University of Utah School of Medicine, Salt Lake City.

6. Applicant allowed the publication of information on, a website that may have been interpreted as indicating that Applicant was entitled to practice medicine in Texas before Applicant received a Texas Medical License.

7. Applicant has cooperated with Board staff. Applicant agrees to the entry of this Agreed Order and to comply with its terms.

CONCLUSIONS OF LAW

Based on the above Findings of Fact, the Board concludes the following:

1. Section 164.001(b)(9) and Section 165.001 of the Act authorize the Board to assess an administrative penalty against a person who violates the Act or a Board Rule.

2. Section 165.156 of the Act prohibits a person from indicating that the person is entitled to practice medicine if the person is not licensed to do so.

ORDER

1. Based on the Findings of Fact and Conclusions of Law, the Board ORDERS that Applicant is hereby GRANTED a Texas Medical License, subject to passage of the Jurisprudence Examination within three attempts and further subject to the payment of an administrative penalty in the amount of $1,000.00 within 30 days after the entry of this Order. The administrative penalty shall be paid in a single payment by cashier's check or money order payable to the Texas Medical Board and shall be submitted to the Director of the Licensure Division for the Board for routing so as to be remitted to the Comptroller of Texas for deposit in the general revenue fund. Upon payment of the administrative penalty, Applicant shall be issued an unrestricted Texas Medical License.

APPLICANT WAIVES ANY FURTHER HEARINGS OR APPEALS TO THE BOARD OR TO ANY COURT IN REGARD TO ALL TERMS AND CONDITIONS OF THIS AGREED ORDER. NOTHING IN THIS ORDER SHALL BE DEEMED A WAIVER OF APPLICANT’S RIGHTS UNDER STATUTE OR THE UNITED STATES OR TEXAS CONSTITUTIONS TO APPEAL AN ORDER OR ACTION OF THE BOARD SUBSEQUENT TO THIS AGREED ORDER EXCEPT AS APPLICANT MAY HAVE OTHERWISE AGREED TO HEREIN. APPLICANT AGREES THAT THIS IS A FINAL ORDER.

THIS ORDER IS A PUBLIC RECORD.

I, BRYAN LAYNE JEPSON, M.D., HAVE READ AND UNDERSTAND THIS AGREED ORDER. I UNDERSTAND THAT BY SIGNING, I WAIVE CERTAIN RIGHTS. I SIGN IT VOLUNTARILY. I UNDERSTAND THIS AGREED ORDER CONTAINS THE ENTIRE AGREEMENT AND THERE IS NO OTHER AGREEMENT OF ANY KIND, VERBAL, WRITTEN OR OTHERWISE.
